Copyright Policy

Effective date: October 12, 2026 · Version 1.2

Clipnote respects the intellectual property rights of others and expects its users to do the same. This policy explains how copyright owners can report content they believe infringes their rights, how users can respond, and how we handle repeat infringers. It follows the US Digital Millennium Copyright Act (DMCA) and is part of our Terms of Service.

1. You Are Responsible for What You Upload

When you upload or publish content on Clipnote, you promise that you own it or have every right needed to use it and to let Clipnote host and display it (see Section 6 of the Terms of Service). Do not upload audio, music, writing, images, or other material you do not have the rights to.

If you own a copyright (or are authorized to act for the owner) and believe content on Clipnote infringes it, send a written notice to our Designated Agent:

Designated Copyright Agent: Andrew Martinez, Clipnote
Email: legal@clipnote.social (subject "DMCA notice")

To be effective under the DMCA (17 U.S.C. § 512(c)(3)), your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act for them;
  2. Identification of the copyrighted work you say is infringed (or a representative list, if there are several);
  3. Identification of the material you say is infringing and enough information for us to find it, such as the link, the creator's handle, and the title of the Note;
  4. Your contact information: name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.

Please note: under 17 U.S.C. § 512(f), you may be liable for damages, including costs and attorneys' fees, if you knowingly and materially misrepresent that material is infringing. If you are unsure whether material infringes your rights, consider talking to a lawyer first.

3. What We Do After Receiving a Valid Notice

When we receive a notice that substantially meets the requirements above, we act quickly to remove or disable access to the material. We then tell the user who posted it and give them a copy of the notice, with the complaining party's personal contact details removed where appropriate.

4. Counter-Notice (If You Believe Your Content Was Removed by Mistake)

If your content was removed and you believe it was removed by mistake or misidentification, you may send a written counter-notice to legal@clipnote.social (subject "DMCA counter-notice") that includes:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and where it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if you are outside the US, any judicial district in which Clipnote may be found), and that you will accept service of process from the person who sent the original notice or their agent.

If we receive a valid counter-notice, we send a copy to the person who sent the original notice. We may restore the material 10 to 14 business days later, unless that person first tells us they have filed a court action to stop the claimed infringement.

5. Repeat-Infringer Policy

In appropriate circumstances, and at our discretion, we close the accounts of users who repeatedly infringe. As a general rule, an account that receives three valid copyright notices within 12 months will be closed. We may act sooner, for example for clear or deliberate infringement.

6. Trademark and Other Intellectual Property

If you believe content on Clipnote infringes your trademark or other intellectual property rights (not copyright), email legal@clipnote.social with a description of the issue, the rights involved, and the specific content.

7. Changes

We may update this policy from time to time. The date and version at the top show when it last changed.
